TERMS AND CONDITIONS

This website is intended for the presentation and sale of original, handmade works of art, as well as for the management of personalised commissions.

The works are made by hand by the artist, so each piece is unique and may show slight variations inherent to handmade work.

Personalised works are produced in accordance with the instructions agreed in advance with the client, including, where applicable, technique, size, colours, subject matter and other details.

Before work begins, the characteristics of the work and the corresponding price will be settled with the client.

Once a personalised commission has begun, substantial changes requested by the client that do not form part of the initial agreement may entail an additional cost and/or a change to the delivery time.

The works may be produced principally using the following techniques:

• Painting on canvas.
• Watercolour.

The materials, finishes and formats used will depend on the characteristics of each commission.

As the works are made by hand, there may be slight differences compared with photographs, sketches or reference images. These differences are part of the handcrafted and unique character of each work.

The approximate time for producing a commissioned work is one month from confirmation of the order and, where applicable, from receipt of the agreed payment.

This timescale is indicative and may vary depending on the size, technique and complexity of the work and the volume of commissions in progress.

Should a significant delay occur, the client will be informed.

The price of each work will be communicated to the client before the commission is confirmed.

The price may vary according to the size, technique, materials, complexity and specific characteristics of the work.

The commission will not be considered confirmed until the price has been agreed and, where applicable, the previously agreed payment or deposit has been made.

Shipping is available throughout Spain via Correos, the Spanish postal service.

Once the work is finished, it will be carefully prepared and packaged in order to reduce the risk of damage during transport.

Shipping costs will be communicated to the client before the purchase or commission is completed, unless it is expressly stated that they are included in the price.

Once the parcel has been handed over to the delivery service, delivery times will depend on the company responsible for the shipment and on the circumstances of transport.

If the work arrives damaged, the client must get in touch as soon as possible and provide photographs of the packaging and of the work so that the incident can be assessed and, where applicable, a claim can be made to the delivery company.

It is recommended that the original packaging be kept until it has been confirmed that the work has arrived in good condition.

Owing to the personalised nature of commissions, the conditions for cancelling and returning a work will depend on whether it is a standard work or a work produced specifically in accordance with the client's instructions.

In particular, personalised works may be subject to the exceptions to the right of withdrawal provided for by the regulations applicable to goods made to the consumer's specifications or clearly personalised.

In all cases, the rights to which the consumer is entitled under Spanish law will be respected.

If you wish to cancel a commission, you must contact me as soon as possible so that the status of the order and the applicable conditions can be reviewed.

The works produced by the artist are protected by the intellectual property legislation in force.

The purchase of a physical work does not imply, unless expressly agreed in writing, the transfer of the intellectual property rights in the work.

The artist may show photographs of the works produced on her website, social media, portfolio or promotional material, unless expressly agreed otherwise with the client.

The photographs, texts, designs, logos and other content on this website are the property of their respective owners and may not be used, copied or reproduced without authorisation where the applicable legislation so requires.

The artist undertakes to produce each work with the utmost care and in accordance with the characteristics agreed with the client.

No liability will be accepted for delays or incidents arising from circumstances beyond the artist's control, such as problems caused during transport, force majeure or other circumstances that cannot reasonably be avoided.

The personal data provided by users will be processed in accordance with the Privacy Policy of this website and with the data protection regulations in force.

The data will be used solely for the purposes notified to the user, such as managing commissions, purchases, payments, shipments or enquiries.

The artist reserves the right to amend these Terms and Conditions where necessary in order to adapt them to legal or commercial changes or to changes in the operation of the website.

The applicable version will be the one published on the website at the time the order or commission is placed.

These Terms and Conditions are governed by Spanish law.

In the event of a dispute, the applicable rules on jurisdiction and consumer protection under the legislation in force will apply.
